Any order of an item for sale on the site www.kaprykabijoux.com requires prior reading, understanding and acceptance of these Terms and Conditions of sale. None of these Terms and Conditions affect your statutory rights as a consumer.
Clicking on the button to confirm an order involves their full acceptance and has value of "digital signature". The site is currently available in French and English.

Article 1 - Purpose

The purpose of the present Terms and Conditions is the definition of the rights and obligations of the seller, Kapryka Bijoux, and the customer on a sale online of jewellery from Kapryka Bijoux on the website www.kaprykabijoux.com
Kapryka Bijoux has the right to modify the terms and conditions of sale at any time, the conditions applicable between the parties being those in force at the date of the order.

Article 3 - Products

These terms and conditions apply only to jewellery from Kapryka bijoux for sale on the site www.kaprykabijoux.com.

The photographic reproductions of items tend to be as faithful as possible to reality. However, please use the indications of dimensions and materials used in the descriptions of products for a better understanding of our offer.
Moreover, Kapryka Bijoux works mostly with natural materials, and many items used in the jewels' making are unique both in their shape and their shades of colour, which makes each jewel unique and potentially different from the picture. Nevertheless, jewellery sent are true to the photograph in terms of kind of items used in the manufacture of the jewel.
The slight differences between the picture and the received jewel is not the responsibility of Kapryka Bijoux.

The jewellery from Kapryka Bijoux comes in an organza pouch where we advise you to keep the jewel in the dark, when you're not wearing it. For greater life of the jewel, we also recommend you not to put your jewellery in contact with water. Other advice are available on the website under the heading "Jewels care" present on the homepage.

Article 4 - Delivery

Kapryka Bijoux delivers worldwide within the coverage areas of La Poste France and its local partners.

Orders placed and paid for (the payment must be validated by the bank) Sunday through Thursday are shipped the next day (excluding public holidays).
Orders placed and paid between Friday and Sunday are sent on Monday, except on public holidays.

The customer is required to verify his package upon arrival and has 48 hours to make any complain with the carrier in case of missing or damaged item.

Delivery times :
To dispatch our jewels outside Metropolitan France, Corsica and Monaco, we use the International Colissimo service, a product of the French national postal services.
European countries : 3 to 7 days
Other countries : 8 to 15 days

Any delays in delivery shall not entitle the client to claim damages.

Delivery prices :
Delivery in Metropolitan France, Corsica and Monaco is offered when the order reaches or exceeds 60 euros TTC.
For orders to be delivered outside France or below 60 euros :
Metropolitan France, Corsica and Monaco : from 3 euros to 7,94 euros according to the size of the jewel.
Overseas territories OM1 : Colissimo Outre - Mer - 10,40 euros
Overseas territories OM2 : Colissimo Outre - Mer - 12,30 euros
World Zone 1 : International Colissimo - 26,00 euros
World Zone 2 : International Colissimo - 34,50 euros

The responsibility of Kapryka Bijoux will not be sought because of damage or delay in delivery.

Article 5 - The order

Before placing an order of jewels from Kapryka Bijoux via internet, any customer must first register and create an account or log in if he/she already has an account on the site www.Kaprykabijoux.com.
The automatic registration systems are regarded as proof of the nature, content and date of the order.

All orders are subject to availability. In the unlikely event that you purchase an item that is not in stock, the customer will be able to cancel the order and receive a full refund.

Before validating an order by its payment, the customer will have a clear vision of the details of his personal data and his order : name, reference, quantity and price of each product and the amount of delivery charges. The customers must have, through a check box, read and accepted these terms and conditions before they can complete their purchase.

Kapryka Bijoux confirms the placement of his order to the customer at the email address he has given us. A second mail is sent to the same address during the packaging of the jewel(s) and then, eventually, Kapryka Bijoux sends a last mail informing the customer that the order was sent.
The sale is considered effective only after the receipt of full payment and its approval by banking services.

Kapryka Bijoux reserves the right to cancel any order from a customer with whom there is a dispute concerning payment of a previous order. The products will be delivered to the delivery address specified by the customer during the ordering process. The information stated by the customer while placing his/her order, are the responsibility of the customer : in case of error in the wording of the details of the addressee, the seller could not be held responsible for failure in the delivery of the product.

At any time, the customer has access via his/her account to the history of his/her orders. The customer can also check the status of the pending orders and consult the last three bills.

Article 6 - Prices

The prices are expressed in euros (€ - EUR) all taxes included.

The prices listed on the products description sheet do not include shipping costs but do include the packaging of the product.

The price charged to the customer is the price indicated on the order confirmation sent by Kapryka Bijoux.

It will not appear VAT (Value Added Tax) on invoices as the company Kapryka bijoux is not subject to VAT (VAT not applicable, Section 293B of the CGI).

Kapryka Bijoux reserves the right to modify prices without notice. However, for all orders accepted, Kapryka Bijoux guarantees the prices charged at the date of confirmation of the order.

Article 7 - The payment

Payment may be made only in Euro :

- Online via the secure payment system PayPal famous worldwide. Payment may be made by credit card or through a PayPal account. The processing of payment is deported to a secure payment area provided by PayPal, and at no time Kapryka Bijoux has access to the buyer's credit card number. The exchanges are therefore totally private.

The order validated by the customer shall be considered effective only when PayPal have given their approval. In case of refusal of the payment, the order will be automatically cancelled and the customer notified by e-mail.

Article 8 - Exchange, return and refund policy

In accordance with the "Code de la consommation " (code of Consumer Affairs), the customer has seven days from the date of receipt of jewellery to retract without having to give reasons or pay penalties, apart from the delivery charges to return the product. This right does not apply to items custom-made to the consumer's specifications. Returns must involve items in perfect conditions in their original packaging with all their accessories. Items returned incomplete, damaged, or soiled will not be taken back. In case of abnormal or abusive returns , Kapryka Bijoux reserves the right to refuse any further order.

Kapryka Bijoux will then proceed to a full refund of the customer, apart from the delivery charges, within a delay of 30 days.

Article 9 - Legal guarantee of conformity

Kapryka Bijoux delivers goods in conformity with the contract and is responsible for the lack of conformity at the time of issuance. In case of non-compliance, the client has a period of two years to act after the issuance of the jewel. After this time, he/she will no longer benefit from the guarantee.

For the customer, two options with no charge excluding postage :

a) The replacement or repair of the item purchased,

or, if this leads to a disproportionate cost taking into account the value of jewellery (for example if the item no longer exists or if the repair is possible but at a cost higher than the replacement)

b) The refund :
- The customer may give the jewel back and get refund (excluding delivery charges)
- The customer may keep the jewel and get a portion of the price.

Articles 10 - Personal details

Personal details that we collect on the site www.kaprykabijoux.com during registration are necessary to enable the proper processing of your orders.

We commit ourselves to keeping your personal details strictly confidential and not to communicate it to any other company.

In enforcement of law on computers no78-17 "Informatique et libertés" (Computing and Liberties) of January the 6th, 1978, you have at any time a right of access and modification on your personal data. This right can be exercised online.

The filing of purchase orders and invoices can be produced as evidence.

The processing of personal data relating to customers by the site www.kaprykabijoux.com has been registered with the National Commission for Computing and Liberties (CNIL).

Article 11 - Law and Dispute Resolution

The parties agree that this contract is subject to the French law and that any dispute will be heard in the courts of France.

Kapryka Bijoux cannot be held liable for damage caused by a malfunction or improper use of jewellery or their packaging. Total liability for any claim against Kapryka Bijoux shall not exceed the price of the items supplied by Kapryka Bijoux to the customer.

In case of dispute, the buyer will apply in priority to Kapryka Bijoux which is committed to finding with the customer an amicable agreement.

Article 12 - Intellectual Property

The photographic reproductions of jewellery are the property of Kapryka Bijoux.
In this respect and in accordance with the provisions of the Intellectual Property Code, only private use is authorised.
Any reproduction, in whole or in part, is systematically subject to approval by Kapryka Bijoux.
